The effective date of this Agreement is March 1, 2007.
Your privacy is very important to VibeAgent (???VibeAgent,??? ???we,??? or ???us???). VibeAgent is an online application that helps people find and book lodging services by soliciting and aggregating user reviews and aggregating pricing and availability information from third party travel suppliers. To accomplish this, our users write and post reviews on Our Website about lodging services. These reviews can then be accessed and read by other VibeAgent users. Our Website provides lodging service recommendations based upon our proprietary algorithm that takes into account the user???s search criteria and preferences, information included in and associated with user submitted reviews, and other information we collect. In most cases, the lodging service recommendations in our search results display aggregated pricing and availability information from third party travel suppliers which may have lodging service options that meet the criteria in your search request. If you choose to book one of the lodging service options we recommend in the search results, you are sent to the third party supplier???s website where you can make a reservation directly with the third party travel supplier. To fulfill the purpose of Our Website, we need to display a limited amount of personal information, so that users are able to evaluate the trustworthiness of a particular review.
I. Information We Collect
When you visit VibeAgent you provide us with two types of information: personal information you knowingly choose to disclose that is collected by us and website use information collected by us as you interact with Our Website.
* Personal Information: VibeAgent collects user submitted account information (???Account Information???) that you provide to us, including, but not limited to, your name, email address, gender, birth date, and location. You are always able to use Our Website without providing us with any personal information; however you may not be able to use certain important features of Our Website.
* User Submitted Content: VibeAgent also collects user submitted reviews, photos, and ratings of businesses and service providers.
* Server Logs: If you access and use Our Website our web server collects and logs certain standard information about your visit, like the pages you view, the links you click on, and other actions you take when using Our Website. We also collect and log certain standard information that your browser communicates to every website you visit such as your IP address, the type of browser you are using, the timestamp, and the website you came from when you linked to the Our Website.

We monitor your activity on the supplier's website to see if you book a reservation, and in doing so we may collect information about your booking (such as name, dates of travel, destination, and payment information; but not credit card information). This information will be linked to your Account Information. You should read the privacy policies on each travel supplier's website you access. We are not responsible for their use of the personal information you supply to them.
* Customer Support Information: If you correspond with us in any manner and for any purpose, we retain such information in order to evaluate and improve Our Website and quality of customer support.
II. How We Use Your Information
We use the information that we collect from you in order to:
* provide you with valuable functionality on Our Website including, without limitation, to personalize and customize the information that we display to you;

VibeAgent does not rent, sell, disclose or share your personal information with any third parties, except in the following limited circumstances:

* We provide certain information that we collect to those travel suppliers with whom you decide to book your travel in order to facilitate your purchases. They will use it to book your reservations and process payments (which may involve your information being processed by third parties involved in the payment authentication process). We are not responsible for use of your data by any travel provider or any such third parties.
* We will disclose information about individual users to governmental or judicial authorities or law enforcement agencies, or to other individuals or entities in response to subpoenas, court orders, or other legal processes.
* We may share information in order to investigate, prevent, or take action regarding illegal activities or suspected fraud, or to enforce or apply our Terms of Service.
* We disclose information when required by law or judicial authority (e.g. to respond to subpoenas, court orders, or legal process, or to protect our legal rights or defend against legal claims).
* We reserve the right to transfer your personal information in the event of a transfer of ownership of VibeAgent, such as an acquisition by or merger with another company. In such an event, VibeAgent will notify you before information about you is transferred and becomes subject to a different privacy policy.

Our website may contain links to third party websites to which we have no affiliation. VibeAgent does not share your personal information with those websites and is not responsible for their privacy practices. We suggest you read the privacy polices on these third party websites.
V. Controlling Your Personal Information
You should be aware that when you voluntarily disclose personally identifiable information (e.g., user name, e-mail address) via reviews, messages, forums, postings, or in other areas of the VibeAgent site, that information, along with any substantive information disclosed in your communication, can be collected and correlated and used by third parties and may result in unsolicited messages from other posters or third parties. Such activities are beyond the control of VibeAgent. Please do not post any personal information on the VibeAgent site or in other areas that you expect to keep private. Although we allow you to set privacy options that limit access to your pages, we cannot control the actions of other posters and third parties with whom you may choose to share your pages and information. Therefore, we cannot and do not guarantee that information you post on Our Website will not be viewed by unauthorized persons.
As a registered VibeAgent user, you can modify your personal information at any time by accessing the "My Account" section of the site. Also, upon your request, VibeAgent will use commercially reasonable efforts to functionally remove you and your personal information from the site; however, it may be impossible to remove your entry without some residual information being retained by VibeAgent. Your VibeAgent account is password-protected. VibeAgent tries very hard to protect our users' information. We use industry standard measures to protect your information that is stored within our database. We limit the access to your information to those employees who need access to perform their job function such as our customer service personnel. VII. Children
This website is not directed to children, and VibeAgent does not knowingly solicit information from any child under the age of 18. Should a child whom we know to be under the age of 18 send personal information to us, we will inform the minor that he or she is ineligible to do so. We will then remove this information from our records.
